For all retired engineers and their family members.3. For all traveling engineers and their family members.3- Subscription fees1 All engineers who are affiliated, whether compulsorily or voluntarily, and retirees and their family members must pay a special annual subscription fee.2 Optional members from the family of non-retired engineers must also pay a special fee.4- Optional membership period and renewal1. Optional membership to the hospitalization and health services program is done within a maximum period of two months from the beginning of the fiscal year, and any voluntary membership application submitted after this date will not be accepted. The affiliation of the family is conditional upon the affiliation of the family members who are responsible for them and after the affiliation of the engineer&#x27;s family members.7. For engineers who have recently joined the Syndicate, the deadline for their families to join the &quot;Fund&quot; is one month from the date of the engineer&#x27;s affiliation.5- Date of commencement of benefit from the hospitalization and health services program1 The benefit of engineers who are mandatorily affiliated to this program and engineers who are voluntarily affiliated mentioned in paragraph 2-&quot;C&quot; and &quot;D&quot; is immediate, i.e. from the date of affiliation represented by filling out the special hospitalization form and paying the annual subscription fee for the program and all fees and subscriptions due for the previous fiscal year.2 The benefit of new engineers begins from the date of issuance of the Council&#x27;s decision to register them in the Syndicate.3 The benefit of voluntary members begins from the date of their affiliation within the specified deadlines and their payment of the required fee for each category of them.Article Five: Social Services Program1. It is a mandatory program for every engineer affiliated with the Syndicate2. This program includes the following benefits and services:1. Life and accident insurance.2. Financial assistance and loans in return for specific benefits and for a specific period according to the principles and conditions determined by the Council later.3. Grants decided by the Board of Directors of the Fund in certain cases for needy and disabled engineers or their families.4. Covering the difference in hospitalization for retired engineers and their families and the families of deceased engineers residing in Lebanon and affiliated with the &quot;Hospitalization and Health Services&quot; program in the second degree in accordance with Clause (b) of Article Two, provided that the difference is calculated for the engineer and each family member after deducting the membership fee due.5. The retired engineer and the engineer who receives a subsidy salary benefit from the accident and life insurance policy within the contractual conditions and upon his request.6. Compensation due to engineers or their families in the following cases:Paragraph 1: The engineer and his family shall benefit from the “Fund” benefits, and the family shall be determined as follows:1. Parents2. The engineer’s legal wife, and in the event of multiple parents, one shall be named at the start of enrollment or the engineer’s husband3. Single children until they reach the age of eighteen,The age requirement is exempted from the following:1. Children who continue their studies, without engaging in any work until they reach the age of twenty-five, provided that they submit study certificates at the beginning of the year in which the insurance is effective, each year, under penalty of forfeiting their right2. Children who are completely unable to work due to congenital or physical disabilities until their death or until these disabilities disappear.This determination shall apply to family members in all cases and provisions in which the expression (the engineer’s family or one of its members is used in this system).Paragraph 2: Determining the value of the assistance stipulated in Article 5-2 of the system and for each case as follows:First case: The engineer&#x27;s natural death or death resulting from an accident covered by the insurance policy.1. The family of the deceased engineer shall be given the assistance specified in the insurance policy for the union year after the legal transactions are completed by the beneficiaries. This assistance shall be distributed to the engineer&#x27;s family members according to the colleague&#x27;s desire, which must be expressed in a written letter submitted to the &quot;Fund&quot; administration and kept as a document in the colleague&#x27;s file. However, if this letter is not submitted, the amount shall be distributed to the engineer&#x27;s family members according to the rules followed by the sect to which he belongs.The entire insurance policy shall be distributed to the engineer&#x27;s family members mentioned in Paragraph 1 of this Appendix according to the inheritance rules followed by the sect to which he belongs. The application of these rules shall be limited to taking into account the applicable percentages

Chapitre Deux : Cotisations au Fonds - Conditions d&#x27;adhésion - Bénéficiaires Les services et offres du Fonds comprennent :-Programme d&#x27;hospitalisation et de services de santé.-Programme de services sociaux.-Autres programmesArticle quatre : Programme d&#x27;hospitalisation et de services de santé :1- L&#x27;abonnement est obligatoirePour tout ingénieur inscrit au Syndicat des Ingénieurs de Tripoli, à l&#x27;exception des ingénieurs mentionnés aux paragraphes 2-C et D. L&#x27;ingénieur affilié doit s&#x27;acquitter d&#x27;une cotisation annuelle particulière2- L&#x27;abonnement est facultatif :1. Pour les membres de la famille de l&#x27;ingénieur légalement affiliés au programme d&#x27;hospitalisation et de services de santé en échange de leur propre cotisation annuelle.2. Pour tous les ingénieurs retraités et les membres de leur famille.3. Pour tous les employés ingénieurs et entrepreneurs des secteurs public et privé qui bénéficient d&#x27;une couverture maladie extérieure au syndicat, en plus de la couverture maladie complète.4. Pour tous les ingénieurs itinérants et les membres de leur famille.3- Frais d&#x27;abonnement1 Tous les ingénieurs affiliés obligatoirement ou volontairement, les retraités et les membres de leur famille doivent s&#x27;acquitter d&#x27;une cotisation annuelle particulière.2 Les membres bénévoles qui sont des membres de la famille d&#x27;ingénieurs non retraités doivent également payer leurs propres cotisations.4- La date limite d&#x27;adhésion volontaire et son renouvellement1. L&#x27;inscription volontaire au Programme d&#x27;hospitalisation et de services de santé s&#x27;effectue dans un délai maximum de deux mois à compter du début de l&#x27;exercice financier et toute demande d&#x27;inscription volontaire soumise après cette date ne sera pas acceptée. Le membre perd volontairement son droit à la continuité s&#x27;il cesse de participer, et les exceptions appliquées au nouveau membre lui sont applicables.2. La demande d’adhésion de tout membre de la famille de l’ingénieur ne sera acceptée que si l’ingénieur a payé tous les frais et cotisations qui lui sont dus pour l’année financière précédente à toutes les caisses syndicales.3. L&#x27;adhésion est gratuite à partir du troisième enfant.4. Pour un nouveau-né, la période d&#x27;adhésion au « Fonds » doit être dans un délai d&#x27;un mois à compter de la date de naissance, et de deux mois pour les personnes hors du Liban.5. Pour les personnes nouvellement mariées, la durée d&#x27;adhésion doit être d&#x27;un mois à compter de la date du contrat de mariage, et de deux mois pour les personnes résidant hors du Liban.6. L’affiliation des parents est conditionnelle à l’affiliation des membres de la famille qui en ont la charge et après celle des membres de la famille de l’ingénieur.7. Pour les ingénieurs nouvellement affiliés au syndicat, le délai d’adhésion de leur famille au « Fonds » est d’un mois à compter de la date d’adhésion de l’ingénieur.5- La date de début de bénéfice du programme d&#x27;hospitalisation et de services de santé1 Le bénéfice des ingénieurs affiliés obligatoires de ce programme et des ingénieurs affiliés volontaires mentionnés au paragraphe 2 - « C » et « D » est immédiat, c&#x27;est-à-dire à compter de la date d&#x27;adhésion, qui est représentée en remplissant le formulaire spécial d&#x27;hospitalisation. formulaire et en payant la cotisation annuelle au programme ainsi que tous les frais et abonnements dus pour l&#x27;exercice précédent.2 Les avantages sociaux des nouveaux ingénieurs débutent à compter de la date de la décision du Conseil de les inscrire au syndicat.3 Les avantages des membres volontaires commencent à compter de la date de leur adhésion dans les délais précisés et du paiement de la cotisation requise pour chaque catégorie.Article cinq : Programme de services sociaux1. Il s&#x27;agit d&#x27;un programme obligatoire pour tout ingénieur affilié au syndicat2. Ce programme comprend les offres et services suivants :1. Assurance vie et accident.2. Aides financières et prêts en échange d&#x27;intérêts déterminés et pour une durée déterminée selon des principes et conditions déterminés ultérieurement par le Conseil.3. Subventions décidées par le Conseil d’Administration du Fonds dans des cas spécifiques en faveur des ingénieurs nécessiteux et handicapés ou de leurs familles.4. Prise en charge de la différence d&#x27;hospitalisation pour les ingénieurs retraités, leurs familles et les familles des ingénieurs décédés résidant au Liban et affiliés au programme « Hospitalisation et Services de Santé » du deuxième degré, conformément à l&#x27;alinéa (b) de l&#x27;article deux, à condition que la différence est calculée pour l&#x27;ingénieur et chaque membre de la famille après déduction de la cotisation d&#x27;affiliation. La conséquence.5. L&#x27;ingénieur à la retraite et l&#x27;ingénieur qui bénéficie d&#x27;une allocation salariale de la police d&#x27;assurance accidents et vie dans les termes contractuels et à sa demande.6. Indemnités dues aux ingénieurs ou à leurs familles dans les cas suivants :Alinéa 1 : L’ingénieur et sa famille bénéficient des cotisations du Fonds, et la famille est déterminée comme suit :1. Parents2. L’épouse légale de l’ingénieur, et s’il y en a plusieurs, alors une est désignée au début de l’affiliation, ou le mari de l’ingénieur3. Les enfants célibataires jusqu&#x27;à l&#x27;âge de dix-huit ans, Exclus de la condition d&#x27;âge :1. Les enfants qui poursuivent leurs études sans exercer aucun travail jusqu&#x27;à l&#x27;âge de vingt-cinq ans, à condition que des certificats de scolarité leur soient présentés au début de l&#x27;année de validité de l&#x27;assurance, de chaque année, sous peine de perdre leur droit.2. Les enfants totalement incapables de travailler en raison d&#x27;un handicap congénital ou physique jusqu&#x27;à leur décès ou jusqu&#x27;à la disparition de ces handicaps.Cette définition s’applique aux membres de la famille dans tous les cas et dispositions où l’expression (la famille de l’ingénieur ou l’un de ses membres dans ce système) est utilisée.Alinéa 2 : Déterminer pour chaque cas la valeur de l&#x27;aide prévue à l&#x27;article cinq-2 du régime comme suit :Premier cas : le décès naturel de l&#x27;ingénieur ou résultant d&#x27;un accident couvert par le contrat d&#x27;assurance.1. La famille de l&#x27;ingénieur décédé reçoit l&#x27;aide prévue au contrat d&#x27;assurance pour l&#x27;année d&#x27;union après la réalisation des actes juridiques par les bénéficiaires. Cette aide est distribuée aux membres de la famille de l&#x27;ingénieur selon le désir du confrère. , qui doit être indiqué dans une lettre écrite remise à l&#x27;administration du « Fonds » et conservée comme pièce au dossier du collègue. Toutefois, en cas de non-présentation de cette lettre, le montant sera réparti entre les membres de la famille de l&#x27;ingénieur selon les modalités. les règles suivies par la secte à laquelle il appartient.La totalité du contrat d’assurance est distribuée aux membres de la famille de l’ingénieur mentionnés au paragraphe 1 de la présente annexe selon les règles successorales suivies par la secte à laquelle il appartient. L&#x27;application de ces règles se limite à la prise en compte des ratios applicables

الفصل الثاني : تقديمات الصندوق - شروط الانتساب إليه – المستفيدين منه ان خدمات وتقديمات “الصندوق” تشمل :-برنامج الاستشفاء و الخدمات الصحية.-برنامج الخدمات الاجتماعية .-برامج أخرىالمادة الرابعة: برنامج الاستشفاء و الخدمات الصحية:1- يكون الاشتراك إلزاميا لكل مهندس مسجل لدى نقابة المهندسين في طرابلس باستثناء المهندسين المذكورين في الفقرة 2-&quot;ج&quot; و &quot;د&quot; و يتوجب على المهندس المنتسب أن يدفع رسم اشتراك سنوي خاص 2- ويكون الاشتراك اختياريا :1. لأفراد عائلة المهندس المنتسب حكما الى برنامج الاستشفاء و الخدمات الصحية لقاء رسم سنوي خاص بهم.2. لجميع المهندسين المتقاعدين وافراد عائلاتهم .3. لجميع المهندسين الموظفين والمتعاقدين في القطاعين العام والخاص الذين تشملهم تغطية صحية من خارج النقابة وذلك بالنسبة المتممة للتغطية الصحية الكاملة .4. لجميع المهندسين المسافرين و أفراد عائلاتهم .3- رسوم الاشتراك1 يتوجب على جميع المهندسين المنتسبين إلزامياً أو اختيارياً و المتقاعدين و أفراد عائلاتهم دفع رسم اشتراك سنوي خاص.2 كما يتوجب على المنتسبين إختيارياً من أفراد عائلة المهندسين غير المتقاعدين دفع رسم خاص بهم كذلك. 4- مهلة الانتساب الاختياري و تجديده1. يتم الانتساب الاختياري إلى برنامج الاستشفاء و الخدمات الصحية في مهلة أقصاها شهرين من ابتداء السنة المالية و لا يقبل أي طلب انتساب اختياري يقدم بعد هذا التاريخ. يفقد المنتسب إختياريا حقه بالاستمرارية إذا انقطع عن الاشتراك و تطبق عليه الاستثناءات المطبقة على المنتسب الجديد.2. لا يقبل طلب انتساب أي من أفراد عائلة المهندس إلا إذا كان هذا الأخير قد سدد كافة الرسوم و الاشتراكات المتوجبة عليه عن السنة المالية السابقة لكافة صناديق النقابة.3. الانتساب مجاني بالنسبة للولد الثالث و ما فوق.4. بالنسبة للمولود الجديد فإن فترة الانتساب إلى “الصندوق” يجب أن تكون خلال فترة شهر واحد من تاريخ الولادة، و شهرين للأشخاص الموجودين خارج لبنان.5. بالنسبة للمتزوج حديثاً فإن فترة الانتساب يجب أن تكون خلال فترة شهر من تاريخ عقد الزواج، و شهرين للأشخاص الموجودين خارج لبنان.6. يكون انتساب الأهل مشروطاً بانتساب أفراد العائلة الذين هم على عاتقهم و بعد انتساب أفراد عائلة المهندس.7. بالنسبة للمهندسين المنتسبين حديثاً إلى النقابة فإن مهلة انتساب عائلاتهم إلى “الصندوق” تكون شهراً واحداً من تاريخ انتساب المهندس. 5- تاريخ بدء الاستفادة من برنامج الاستشفاء و الخدمات الصحية1 إن استفادة المهندسين المنتسبين إلزامياً من هذا البرنامج و المهندسين المنتسبين إختيارياً المذكورين في الفقرة 2-&quot;ج&quot; و &quot;د&quot; هي فورية أي من تاريخ الانتساب المتمثل بتعبئة نموذج الاستشفاء الخاص و بتسديد رسم الاشتراك السنوي الخاص بالبرنامج و كافة الرسوم و الاشتراكات المتوجبة عن السنة المالية السابقة.2 تبدأ استفادة المهندسين الجدد من تاريخ صدور قرار المجلس بتسجيلهم في النقابة.3 تبدأ استفادة المنتسبين إختيارياً من تاريخ انتسابهم ضمن المهل المحددة و تسديدهم الرسم المتوجب الخاص بكل فئة منهم. المادة الخامسة: برنامج الخدمات الاجتماعية 1. وهو برنامج إلزامي لكل مهندس منتسب إلى النقابة 2. يشمل هذا البرنامج التقديمات والخدمات التالية: 1. التامين على الحياة و ضد الحوادث . 2. المساعدات والقروض المالية لقاء فوائد محددة ولمدة محددة وفق اسس وشروط يحددها المجلس لاحقا . 3. المنح التي يقررها مجلس إدارة الصندوق في حالات معينة للمحتاجين والعجزة من المهندسين أو من عائلاتهم . 4. تغطية فارق الاستشفاء للمهندسين المتقاعدين وعائلاتهم وعائلات المهندسين المتوفين المقيمين في لبنان والمنتسبين إلى برنامج &quot;الاستشفاء و الخدمات الصحية &quot; في الدرجة الثانية وذلك وفقا للبند (ب) من المادة الثانية على أن يحتسب الفارق للمهندس و لكل فرد من أفراد العائلة بعد حسم رسم الانتساب المترتب. 5. استفادة المهندس المتقاعد ، والمهندس الذي يتقاضى راتب إعانة ، من بوليصة التامين ضد الحوادث وعلى الحياة ضمن الشروط التعاقدية و بناءً على طلبه . 6. التعويضات التي تستحق للمهندسين أو لعائلاتهم في الحالات التالية : الفقرة 1 :يستفيد من تقديمات “الصندوق” المهندس و عائلته و تحدد العائلة على الشكل التالي: 1. الوالدان2. زوجة المهندس الشرعية و في حال تعددهن فواحدة تسمى عند بدء الانتساب أو زوج المهندسة3. الأولاد العازبين حتى إكمالهم سن الثامنة عشر، يستثنى من شرط السن:1. الأولاد الذين يتابعون دراستهم، دون تعاطي أي عمل حتى إكمالهم الخامسة و العشرين من عمرهم على أن تقدم لهم إفادات دراسية في بداية السنة التي يسري فيها التأمين ، من كل عام ، تحت طائلة إسقاط حقهم2. الأولاد العاجزون كلياً عن العمل بسبب إصابتهم بعاهات خلقية أو جسدية حتى وفاتهم أو حتى زوال هذه العاهات. يطبق هذا التحديد لأفراد العائلة في جميع الحالات و الأحكام المستعمل بها تعبير (عائلة المهندس أو أحد أفرادها في هذا النظام).الفقرة 2 : تحديد قيمة المساعدات المنصوص عليها في المادة الخامسة -2 من النظام ولكل حالة من الحالات على الوجه الآتي : الحالة الأولى : وفاة المهندس الطبيعية أو الناتجة عن حادث مشمول ببوليصة التأمين. 1. تعطى عائلة المهندس المتوفى المساعدة المحددة في بوليصة التأمين للعام النقابي وذلك بعد إتمام المعاملات القانونية من قبل المستفيدين ، توزع هذه المساعدة على أفراد عائلة المهندس حسب رغبة الزميل المتوجب إبداؤها بكتاب خطي يقدم لادارة “الصندوق” ويحفظ كمستند في ملف الزميل ، أما في حال عدم تقديم هذا الكتاب ، فيوزع المبلغ على أفراد عائلة المهندس وفقا للقواعد المتبعة لدى الطائفة التي ينتمي إليها .توزع كامل بوليصة التأمين على أفراد عائلة المهندس المذكورين في الفقرة 1 من هذا الملحق حسب القواعد الإرثية المتبعة لدى الطائفة التي ينتمي إليها . ويقتصر تطبيق هذه القواعد على الأخذ بالنسب المعمول بها فيما بينهم . ولا يمكن لأي من الورثة المحتملين من غير أفراد العائلة المحددة في الفقرة 1 من هذا الملحق أن يستفيدوا بأي حال من المساعدة المحددة في بوليصة التأمين المذكورة أعلاه .في حال عدم وجود أي من أفراد عائلة المهندس المحددين في الفقرة 1 من هذا الملحق ،فان المساعدة تعود لصندوق التقديمات الاجتماعية . 2. يعطى أولاد المهندس المتوفى الخمسة الأكبر سنا وكحد أقصى وبشكل اسمي منحة تعليم تحدد لكل واحد منهم وفقا للموازنة الموضوعة بهذا الشان ولكافة مراحل التعليم .لا تعطى منح التعليم إلا بتوفر شرطين أولهما أن يكون الولد يتلقى فعلا العلم وثانيهما ان لا يكون قد تجاوز :الثالثة عشرة من عمره لمرحلة التعليم الابتدائي . السابعة عشرة من عمره لمرحلة التعليم التكميلي .العشرين من عمره لمرحلة التعليم الثانوي .الخامسة والعشرين من عمره لمرحلة التعليم الجامعي .3. يعطى أفراد عائلة المهندس باستثناء الوالدين والزوجة او الزوج في حال زواجهما مجددا، ضمان استشفاء مجاني بناءً على طلب يقدم من المستفيدين في بداية كل سنة. الحالة الثانية : إصابة المهندس بعلة مقعدة عن العمل كليا : في حال إصابة المهندس بعلة تقعده عن العمل كليا وبصورة دائمة ، نتيجة حادث أو مرض ، وعند ثبوت العجز الكلي والدائم بشكل نهائي يستفيد المهندس المقعد من المكتسبات التالية:.1. المبلغ المحدد في بوليصة التأمين2. مساعدة شهرية أو مقطوعة تحدد من قبل مجلس النقابة أو لجنة إدارة “الصندوق” وفقا لموارد “الصندوق” وإمكاناته .3. يعطي أولاد المهندس الخمسة الأكبر سنا كحد أقصى وبشكل اسمي منح التعليم ذاتها المنصوص عنها في هذا النظام .4. ضمان استشفاء مجاني للمهندس وأفراد عائلته باستثناء الوالدين إلا إذا كان المهندس هو المعيل الوحيد على أن تتوفر فيهما الشروط الموضوعة لبرنامج الاستشفاء و ذلك بناءً على طلب يقدم من المستفيدين في بداية كل سنة.5. تسديد رسم الاشتراك الثابت في النقابة والصندوق التقاعدي عن المهندس حتى إحالته على التقاعد . الحالة الثالثة : اصابة المهندس بعلة مقعدة عن العمل جزئيا : في حال اصابة المهندس بعلة تقعده عن العمل جزئيا وبصورة دائمة يعطى المساعدات المنصوص عنها في بوليصة التأمين بالإضافة إلى : 1. ثلث قيمة المعاش التقاعدي إلا إذا كان بالإمكان إحالته على التقاعد أو استحقاقه التقاعد بمعاش كامل .2. يعطى الأولاد الخمسة الأكبر سنا كحد أقصى وبشكل اسمي منح التعليم المنصوص عنها في هذا النظام . الحالة الرابعة 	:تعويض نفقات الدفن : يعطى تعويض نفقات دفن مقطوع بناء لقرار لجنة إدارة “الصندوق” بعد موافقة مجلس النقابة ويحدد سنويا . 1. إلى المهندس في حال وفاة أحد إفراد عائلته حسب التحديد المذكور في الفقرة 1 من هذه المادة باستثناء الوالدين شرط أن لا يقل عمر المتوفى عن ثلاث سنوات .2. إلى أحد أصحاب الحق المذكورين في الفقرة 1 من هذه المادة في حالة وفاة المهندس وذلك بمعرفة المجلس ، وحسب تقديره لكل حالة . المادة السادسة : برامج أخرى يقدمها “الصندوق” : أي برنامج آخر يتبناه “الصندوق” يطرح من قبل مجلس النقابة في ملحق خاص يشرح تفاصيل البرنامج، كيفية الانتساب إليه و إجراءا ته و التقديمات التي يستفيد منها المنتسب إليه، على أن تكون هذه البرامج اختيارية و مفتوحة لكل مهندس مسجل في النقابة.

الفصل الثالث – مجلس الادارة – تأليفه و انتخابه – مهامه و وظائفه المادة السابعة : تأليف مجلس ادارة “الصندوق” وانتخابه :يدير الصندوق مباشرة مجلس النقابة الذي يخضع لأحكام الباب الخامس من النظام الداخلي للنقابة المادة الثامنة : مهام ووظائف مجلس ادارة “الصندوق” :يتولى مجلس ادارة “الصندوق” درس القضايا المتعلقة ب”الصندوق” ويتخذ القرارات اللازمة بشأنه ويبحث بصورة خاصة في الامور التالية :1- تطبيق احكام هذا النظام .2- الإشراف والإدارة والمراقبة على جميع اعمال “الصندوق” . 3- وضع التقرير السنوي والموازنة السنوية قبل عرضها على هيئة المندوبين لتصديقها.4- الاطلاع على حسابات “الصندوق” والتدقيق فيها وعند التحقق من وجود أي خطا أو خلل أو تجاوز أو سؤ استعمال او اية مخالفة اخرى تلحق الضرر ب”الصندوق” ، اقتراح إجراء التحقيقات اللازمة الآيلة إلى ملاحقة المسؤولين عن ذلك على الاصعدة القضائية والإدارية والمالية والمسلكية .5- تحصيل أموال “الصندوق” ومستحقاته والاشتراكات والواردات .6- صرف التقديمات والمساعدات والقروض للمنتسبين الى “الصندوق” .7- التدقيق والبت بالأمور المتعلقة بدفع الصرفيات وقبض الرسوم و إدارة حساب “الصندوق” في المصارف و الإشراف على تحصيل امواله وحفظها .8- امتلاك واستثمار الاموال المنقولة وغير المنقولة اللازمة لسير عمله او لتحقيق الاغراض التي أنشئ من اجلها . 9- و له الحق بتعيين لجنة خاصة لادارة “الصندوق” يوكل إليها كافة الصلاحيات العائدة له بموجب هذا النظام على ان يكون عمل هذه اللجنة باشرافه وتحت رقابته.

A minimum of 10% of its total revenues during each fiscal year shall be deducted for the general reserve, and the minimum must be secured at the latest by the end of the tenth fiscal year following the implementation of the “Fund” (and the remainder without modification).In the event that the “Fund’s” expenses and expenditures exceed its revenues during one fiscal year, the difference shall be taken from the reserve fund.If it becomes clear at the end of the same fiscal year that the reserve fund has not reached the specified minimum, the Board of Directors shall decide either to reduce the contributions or, after the approval of the Delegates’ Body, to raise the subscription rate by an amount sufficient to restore the financial balance within a maximum period of two years.If it becomes clear at the end of the same fiscal year that the reserve fund has exceeded the specified minimum, the surplus over the expenses of one year shall be reserved in an item created in the Fund’s budget under the name of expected calculated expenses.Article Twelve: Employment of the “Fund’s” funds:After the approval of the Syndicate Council, the surplus of the Fund’s permanent reserve fund may be employed according to the following:1- In loans given to subscribers in return for a specified interest.2- In Loans given to official institutions in return for a specified interest.3- In other loans proposed by the Board of Directors of the “Fund”, with a specified interest in return for certain and safe guarantees (mortgage, bank guarantee given by the Bank of Lebanon)4- In any other safe investments proposed by the Board of Directors of the “Fund”.

الفصل الرابع : واردات الصندوق – نفقاته – إحتياطه – توظيف أموالهالمادة التاسعة : واردات “الصندوق” :تتألف واردات “الصندوق” مما يلي :برنامج الاستشفاء و الخدمات الصحية 1- بدلات الاشتراك السنوية الإلزامية.2- بدلات الاشتراك الاختيارية.3- رسم عن كل متر مربع مسجل في النقابة.4- نسبة مئوية من دخل كافة المهندسين الغير مستفيدين من الكوتا.5- فوائد رسوم الاشتراك6- فوائد مصرفية7- فروقات صرف إيجابيةبرنامج الخدمات الاجتماعية 8- بدلات الاشتراك السنوية الإلزامية في برنامج الخدمات الاجتماعية.9- المساعدات الحكومية والمساعدات الواردة من مصادر اخرى .10- السلفات القانونية التي يمكن ان يحصل عليها “الصندوق” .11- تسديدات القروض المتضمنة الفوائد .12- تسديدات سلفات سبق ان عجلها “الصندوق” .13- عائدات ومردود التوظيفات الناتجة عن استثمار اموال “الصندوق” (وهي غير القروض بصفة عامة ) وفوائد هذه الأموال لدى المصارف .14- الهبات والتبرعات .15- أي رسوم أخرى توافق عليها هيئة المندوبين بعد اقتراح المجلس. المادة العاشرة : نفقات “الصندوق”:تتألف نفقات “الصندوق” مما يلي : 1- تغطية نفقات تقديمات “الصندوق” ببرامجها المختلفة وتعويضات الوفاة والعجز الكلي والجزئي .2- القروض المالية المعطاة بفائدة .3- التسديد من اصل السلفات والقروض المتوجبة على “الصندوق” إذا وجدت .4- الضرائب والرسوم لصالح الدولة او لصالح البلديات في حال فرضها . 5- النفقات اللازمة لتأمين القرطاسية والمطبوعات ولدفع الرواتب والتوظيفات المقطوعة والمكافآت لتسيير أعمال “الصندوق” .6- بعض النفقات المختلفة غير الواردة أعلاه . 7- فوائد مصرفية8- فروقات صرف سلبية المادة الحادية عشر : تكوين احتياط “الصندوق”: ينشأ لصندوق التقديمات الاجتماعية – برنامج الخدمات الاجتماعية – مال احتياط دائم يكفي لتغطية نفقات سنة واحدة على الأقل . يقتطع كحد أدنى 10% من مجموع وارداته خلال كل سنة مالية لصالح الاحتياط العام ويجب تأمين الحد الأدنى على أبعد تقدير في نهاية السنة المالية العاشرة التي تلي وضع &quot; الصندوق موضع التنفيذ ( والباقي بدون تعديل ) في حال زادت مصاريف ونفقات “الصندوق” على وارداته خلال سنة مالية واحدة يؤخذ الفرق من مال الاحتياط . واذا تبين في نهاية السنة المالية نفسها بان مال الاحتياط لم يبلغ الحد الادنى المحدد فان مجلس الادارة يقرر إما خفض التقديمات او بعد موافقة هيئة المندوبين رفع معدل الاشتراكات بقدر كاف لاعادة التوازن المالي في مهلة سنتين على الاكثر . وإذا تبين في نهاية السنة المالية نفسها بأن مال الاحتياط قد فاق الحد الأدنى المحدد يتم حجز الفائض عن مصاريف سنة في بند ينشأ في موازنة الصندوق باسم أعباء محتسبة متوقعة. المادة الثانية عشر : توظيف اموال “الصندوق” : يمكن ، و بعد موافقة مجلس النقابة، توظيف فائض مال الاحتياط الدائم للصندوق وفقا لما يلي :1- في قروض تعطى للمشتركين لقاء فائدة محددة .2- في قروض تعطى للمؤسسات الرسمية لقاء فائدة محددة .3- في قروض اخرى يقترحها مجلس ادارة “الصندوق” ، محددة الفائدة لقاء ضمانات اكيدة وآمنة (رهن، كفالة مصرفية معطاة من قبل مصرف لبنان )4- في أي توظيفات اخرى امينة يقترحها مجلس ادارة “الصندوق” .

Chapitre Quatre : Les revenus du Fonds - ses dépenses - ses réserves - l&#x27;utilisation de ses fondsArticle Neuf : « Fonds » pour les importations :Les importations du Fonds sont les suivantes :Programme d&#x27;hospitalisation et de services de santé1- Frais d&#x27;abonnement annuel obligatoires.2- Indemnités de souscription facultatives.3- Une redevance pour chaque mètre carré inscrit au syndicat.4- Un pourcentage des revenus de tous les ingénieurs qui ne bénéficient pas du quota.5- Avantages des frais d&#x27;abonnement6- Intérêts bancaires7- Différences de change positivesProgramme de services sociaux8- Allocations annuelles obligatoires de cotisation au programme des services sociaux.9- Aide gouvernementale et aide reçue d&#x27;autres sources.10- Avances juridiques que le Fonds peut obtenir.11- Remboursements du prêt, intérêts compris.12- Remboursements des avances préalablement versées par le Fonds.13- Les rendements et retours sur investissements résultant du placement des fonds du Fonds (qui ne sont pas des prêts en général) et les intérêts de ces fonds auprès des banques.14- Cadeaux et donations.15- Tous autres frais approuvés par le corps des délégués après proposition du Conseil.Article dix : Dépenses du « Fonds » :Les dépenses du Fonds sont les suivantes :1- Prise en charge des dépenses des différents programmes du Fonds, des indemnités de décès et d’invalidité totale et partielle.2- Prêts financiers accordés à intérêts.3- Paiement du principal des avances et des prêts dus par le Fonds, le cas échéant.4- Taxes et redevances au profit de l&#x27;État ou au profit des communes si elles sont imposées.5- Les dépenses nécessaires à l’achat de papeterie et de publications et au paiement des salaires, sommes forfaitaires et primes pour mener à bien les travaux du Fonds.6- Quelques dépenses diverses non mentionnées ci-dessus.7- Intérêts bancaires8- Différences de change négativesArticle Onze : Constitution de la réserve du Fonds : Un fonds de réserve permanent suffisant pour couvrir les dépenses d&#x27;au moins un an sera établi pour le Fonds de prestations sociales - le Programme des services sociaux. Un minimum de 10% de ses revenus totaux sera prélevé au cours de chaque exercice au profit de la réserve générale, et ce minimum devra être assuré au plus tard à la fin du dixième exercice suivant la mise en place du Fonds (et le reste sans modification). Si les dépenses et dépenses du Fonds dépassent ses revenus au cours d’un exercice financier, la différence sera prélevée sur la monnaie de réserve. S&#x27;il apparaît à la fin du même exercice que la réserve monétaire n&#x27;a pas atteint le minimum fixé, le Conseil d&#x27;administration décide soit de réduire les cotisations, soit, après approbation du collège des délégués, d&#x27;augmenter le taux de souscription d&#x27;un montant montant suffisant pour rétablir l’équilibre financier dans un délai de deux ans au maximum. S’il apparaît à la fin du même exercice financier que l’argent de réserve a dépassé le minimum spécifié, l’excédent des dépenses d’un an sera réservé dans un poste créé dans le budget du fonds au nom des charges calculées attendues.Article Douze : Placement des fonds du Fonds :Après approbation du Conseil Syndical, l’excédent de la réserve permanente du Fonds pourra être utilisé selon les modalités suivantes :1- Dans les prêts accordés aux souscripteurs en échange d&#x27;un intérêt spécifique.2- Dans les prêts accordés à des institutions officielles en échange d&#x27;un intérêt spécifique.3- En d’autres prêts proposés par le Conseil d’Administration du Fonds, à intérêt fixe contre des garanties sûres et sécurisées (hypothèque, garantie bancaire donnée par la Banque du Liban).4- Dans tout autre investissement honnête proposé par le conseil d’administration du Fonds.

الفصل الخامس : تأدية المساعدات المادة الثالثة عشر :تؤدى المساعدات و التقديمات المنصوص عليها في هذا النظام بتاءً على طلب نموذجي خاص بكل نوع من التقديمات تضعه لجنة إدارة الصندوق، و يقدم من قبل المستفيد أو المستفيدين إلى المجلس المذكور مرفقاً بالمستندات اللازمة . المادة الرابعة عشر :تتمتع لجنة إدارة الصندوق بكامل الصلاحيات لتقدير توجب التقديمات على ضوء أحكام هذا النظام ، ولها الحق بإجراء التحقيقات اللازمة مباشرة أو بواسطة من تكلفه البت بطلب المساعدة.المادة الخامسة عشر :يتعرض كل من يقبض مبلغاً من المال من صندوق التقديمات الاجتماعية بطريقة غير مشروعة مخالفة لأحكام هذا النظام، للعقوبات المنصوص عليها في قانون مزاولة الهندسة و النظام الداخلي للنقابة و يلزم بإعادة المبلغ المقبوض مع فائدة 9% مركباً اعتبارا من تاريخ القبض، تحت طائلة المسؤولية القضائية وفقاً للقوانين العامة.المادة السادسة عشر :يحق للجنة إدارة الصندوق ، بعد موافقة مجلس النقابة ، أن تقرر عند الاقتضاء توفير المساعدات المنصوص عليها في هذا النظام أو بعضها عن طريق التعاقد مع إحدى شركات التامين.

الفصل السادس : أحكام مختلفة - تعديل النظام – أحكام انتقالية المادة السابعة عشر : أحكام مختلفة : 1- يكون استثناء المهندسين الموظفين و المتعاقدين و المسافرين الوارد في المادة الرابعةً فقرة 2-&quot;ج&quot; و &quot;د&quot; على سبيل التجربة في السنة الأولى من تطبيق هذا النظام حيث يتم على ضوء ذلك اتخاذ القرار النهائي باستمرارية الاستثناء أو إلغائه.2- إذا اختار المهندس الموظف أو المتعاقد الانتساب بالنسبة المتممة للتغطية الصحية يتوجب عليه دفع رسم انتساب خاص يوازي ثلثي رسم الانتساب الإلزامي شرط أن يقدم صورة عن بطاقة الضمان الصحي أو التعاونية ... وفي حال عدم توفر ذلك يدفع رسم الانتساب الإلزامي كاملا .3- يتم استيفاء دفعة، يحددها مجلس النقابة، على حساب رسم الاشتراك في برنامج الاستشفاء و الخدمات الصحية خلال شهر شباط من كل سنة و ذلك تأميناً للدفعة الأولى التي تتوجب عادة في بداية السنة لشركات التأمين وإحصاء دقيقا لعدد المنتسبين الإلزاميين منهم والاختياريين . وتجري المحاسبة النهائية عند إقرار رسم الاشتراك بصورة نهائية من قبل هيئة المندوبين .4- يفقد المهندس حقه بالاستفادة من مساعدات الصندوق وتقديماته فور شطبه من جدول النقابة .5- تلغى اعتبارا من تاريخ وضع هذا النظام موضع التنفيذ الفعلي جميع الأحكام والأنظمة الصادرة عن الجمعية العامة أو مجلس النقابة والتي تتناول حالات وأحكام مشمولة بهذا النظام .6- يوقف العمل بصندوق الضمان الذاتي وضمان الطوارىء الخاص بالبنائين الاحرار وبصندوق الضمان الذاتي وضمان الطوارئ الخاص بالاخصائيين الاحرار وتتخذ الترتيبات اللازمة لتصفيتهما .7- يوقف العمل بصندوق الاعانة وتنقل امواله الى صندوق التقديمات الاجتماعية .8- على مجلس النقبة ان يضع خلال ستة اشهر الآلية الخاصة بأصول تعيين لجنة ادارة الصندوق.9- تعتبر الكتب التي أبدى فيها المهندسون رغبتهم بكيفية توزيع قيمة بوليصة التأمين في ظل نظام &quot; صندوق الإعانة &quot; سارية المفعول في ظل هذا النظام ( نظام صندوق التقديمات الاجتماعية )10- يعمل بهذا النظام المعدل ويصبح نافذا من 1/3/2002المادة الثامنة عشر : في تعديل النظام : يعود لمجلس النقابة بأكثرية ثلثي أعضائه ، تعديل هذا النظام أو البعض منه مع اضافة مواد جديدة وفقا للتطورات كما يعود لمجلس النقابة اصدار البرامج الجديدة أو تعديل المعمول به على ن يسري مفعولها في بداية السنة المالية التالية . 1. يغطي برنامج الخدمات الاجتماعية وفقا لاحكامه الاشخاص المستفيدين من صندوق الاعانة قبل توقف العمل به .2. ان الديون المترتبة على المهندسين وعائلاتهم قبل العمل بهذا النظام تبقى مع فوائدها مستحقة الأداء لصندوق النقابة

Il a le droit d&#x27;ester en justice au nom du Comité de Gestion du Fonds selon les procédures établies, et en cas d&#x27;absence, le Président Adjoint le représente.Article 9 Le vice-président exerce toutes les fonctions et pouvoirs du président pendant l&#x27;absence du président et assume la présidence du comité de gestion du fonds.Article 10 Le comité de gestion du fonds est généralement responsable de :1- Récupérer l&#x27;argent de ce fonds, l&#x27;investir et le stocker dans une ou plusieurs banques acceptables par le gouvernement.2- Préparer et publier le relevé de compte de l&#x27;exercice écoulé et le présenter à l&#x27;Assemblée Générale Ordinaire des Ingénieurs pour approbation et quittance.C - Préparer le budget annuel et le présenter à l&#x27;assemblée générale ordinaire pour approbation par l&#x27;intermédiaire d&#x27;un conseil Syndicat.D - Étudier et détailler les conditions de retraite et déclarer les salaires et les allocations de retraite.E - Nommer et révoquer les salariés de la Caisse, déterminer les modalités de cette nomination et décider de tout ce qui les concerne.F- Rapport sur le décaissement des sommes dues par le Fonds.Article 11 L&#x27;exercice financier du Fonds commence le premier mars et se termine à la fin février de l&#x27;année suivante. (Modifié par la Résolution n°20/2013-2014 du 27/01/2014)Article 12 En cas de retard dans la ratification du nouveau budget par l&#x27;Assemblée générale, la collecte et les dépenses se poursuivront sur la base de la règle des douze décimales du budget précédent.Article 13 Chaque demande soumise au Comité de Gestion du Fonds est enregistrée dans les procès-verbaux reçus puis présentée au Président du Comité qui la transmet au Comité de Gestion du Fonds. Quant aux demandes nécessitant une instruction, elles sont soumises au Comité de Gestion du Fonds.

Engineers&#x27; Retirement Fund LawNo. 64/11Article 1A retirement fund shall be established at each of the Engineers&#x27; Syndicates in Beirut and Tripoli in accordance with the provisions of Article 52 of the Engineering Practice Law and the Engineers&#x27; Syndicate issued on January 22, 1951.The purpose of the fund is to provide a retirement pension for Lebanese engineers who have stopped working due to age or illness and for their families after their death, in accordance with the conditions included in this law.Article 2Every Lebanese member who meets the conditions set forth in this law must participate in the Engineers&#x27; Retirement Fund.Chapter One: Fund ResourcesArticle 3This fund shall be fed from the following resources:1 - 30% of the reserve funds available in the Syndicate&#x27;s fund upon the issuance of this law.2 - 30% of the registration fees and 20% of the annual subscriptions collected from engineers in accordance with Article 15 of the Engineering Practice Law mentioned above.3 - Donations (gifts, wills or subscriptions) provided to the fund.4 - The government&#x27;s annual contribution to the fund.5 - What the General Assembly decides to allocate to this fund in the annual budget.6 - An annual retirement fee decided by the General Assembly and imposed on every engineer participating in the fund based on a reasoned proposal from the Fund Management Committee and approved by the Syndicate Council. This fee is paid before the first of March of each year.7 - Interest and revenues from investing the fund&#x27;s funds.8 - 5% added to the building permit fee collected by the Syndicate for the benefit of the Retirement Fund before the license is granted by the municipality.9 - 20% twenty percent of the annual income tax actually paid by the engineer participating in the Retirement Fund.10 - 70% seventy percent of the stamp fee that the Syndicate Council has authorized to issue and is mandatory affixed to the following transactions carried out by every member of the Syndicate, provided that the remaining thirty percent is entered as revenues for the Syndicate&#x27;s general fund:Stamp value G.L.- Copies of maps submitted to official departments 250- Fee contracts concluded with the government or individuals and expert reports 1000- Technical consultations and complaints submitted to the Syndicate.- Building permits (stamp affixed by the administration) 2000- Fee estimation request submitted to the Syndicate Council 1000- Fee estimation decision affixed a relative stamp of one percent of the estimated value.Article 4- The fund shall be managed by a committee composed of:1 - The Syndicate President or his deputy in his absence as Chairman.2 - A member of the Syndicate Council elected by the Syndicate Council for a renewable one-year term.3 - The Syndicate President whose term has expired immediately as a member for a period of three years.4 - Three members elected by the Syndicate Council for a period of three years from among the former Syndicates.5 - Three members elected by the General Assembly for a period of three years from among the engineers who have previously been members of the Syndicate Council for a period of at least three years.All members elected in accordance with clauses 4 and 5 may be re-elected.The term of one-third of the members elected in accordance with each of Articles 4 and 5 above shall expire each year, and members whose term has expired shall be appointed by lot in the first and second years after the first election held in accordance with this law.No engineer who has been convicted by the Disciplinary Board or any Lebanese court of a crime affecting honor and dignity shall be entitled to be a member of the committee.Article 5The Fund Management Committee shall elect from among its members by secret ballot a Secretary, a Treasurer and an Accountant.Article 6The Fund Management Committee shall meet once a month to review the fund’s accounts, expenditures and revenues, and the President shall have the right to call the committee when necessary. The session shall not be considered legal unless attended by more than half of the members, including the President or his deputy.The committee’s decisions shall be taken by a majority vote of its present members, and if the votes are equal, the President or his deputy in his absence shall have the casting vote.Article 7The General Assembly shall elect each year from among its members a three-member oversight committee to audit the records and entries of the Fund’s books. These auditors shall have full authority to seek the assistance of expert accountants from outside the Syndicate.The General Assembly shall have the authority to suspend members of the Fund Committee from work in the event that their misconduct or embezzlement of Fund funds is proven.Article 8The Fund Management Committee shall be responsible for the Retirement Fund and shall have control over it. It shall take the necessary measures to collect and invest funds and estimate the disbursement of salaries and allowances to those entitled thereto or to cut them off in accordance with this law. It shall organize the annual budget and present it to the General Assembly for approval through the Syndicate Council.The Fund Committee shall obtain the approval of the General Assembly in all matters of a preliminary nature.Article 9The Treasurer may keep an amount of money not exceeding one thousand Lebanese pounds in his fund for emergency and urgent matters. He may not disburse any amount except by a decision from the Fund Committee.Article 10The Fund&#x27;s funds shall be deposited in a bank designated by the Fund Management Committee, and no amount of money may be withdrawn except by a decision of this Committee, signed by the Chairman or his Deputy in his absence, and the Treasurer.Article 11The Fund Management Committee shall prepare the annual budget in November of each year and present it to the Ordinary General Assembly.Article 12The Fund Management Committee, under the supervision of the Ministry of Finance, shall arrange, classify and determine the quantity of stamps stipulated in this law, and no one may sell these stamps except by virtue of a license obtained from the Fund Management Committee.Article 13The stamps stipulated in this law shall be subject to the general legal provisions pertaining to the Amiri stamps with regard to their suspension, forgery, sale without a license from the Syndicate, or sale for more than their value, and other violations.Article 14Every member who has reached the age of sixty may

Cette cotisation est versée avant le premier mars de chaque année.7 - Intérêts et revenus provenant du placement de l’argent du fonds.8 à 5 % sont ajoutés au droit du permis de construire et sont collectés par le syndicat au profit de la caisse de retraite avant la délivrance du permis par la commune.9 - 20 % Vingt pour cent de l&#x27;impôt sur le revenu annuel effectivement payé par l&#x27;ingénieur participant à la caisse de retraite.10- 70% - Soixante-dix pour cent du droit de timbre approuvé par le Conseil Syndical pour son émission et est obligatoirement apposé sur les transactions suivantes : Une déclaration faite par chaque membre du syndicat, à condition que les trente pour cent restants entrent en revenus au fonds général du syndicat : La valeur du timbre est G.L.- Copies de cartes soumises aux services officiels 250- Contrats d&#x27;honoraires conclus avec l&#x27;État ou des particuliers et expertises 1000 Consultations techniques et plaintes déposées auprès du syndicat. - Permis de construire (cachet apposé par l&#x27;administration) 2000 - Demande d&#x27;estimation d&#x27;honoraires soumise au Conseil Syndical 1000La décision d&#x27;estimation des honoraires sera apposée avec un cachet relatif d&#x27;un pour cent de la valeur estimée.Article 4 Le fonds est géré par un comité composé de :1 - Le Capitaine ou son adjoint en cas d&#x27;absence de Président.2 - Un membre du Conseil Syndical élu par le Conseil Syndical pour une durée d&#x27;un an, susceptible de renouvellement.3 - Le capitaine dont le mandat est expiré est membre depuis trois ans.4 - Trois membres élus par le Conseil Syndical pour une durée de trois ans parmi les anciens capitaines.5 - Trois membres élus par l&#x27;Assemblée Générale pour une durée de trois ans parmi les ingénieurs préalablement membres du Conseil Syndical depuis au moins trois ans. Tous les membres élus peuvent être réélus conformément aux articles 4 et 5. Chaque année, le mandat d&#x27;un tiers des membres élus conformément aux articles 4 et 5 ci-dessus expire, et les membres dont le mandat expire sont désignés par tirage au sort dans la première et la deuxième année après la première élection tenue conformément à la présente loi. Tout ingénieur qui a été condamné par le Conseil de Discipline ou par tout tribunal libanais pour un crime portant atteinte à l&#x27;honneur et à la dignité n&#x27;a pas le droit d&#x27;être membre du comité.Article 5 Le Comité de Gestion du Fonds élit parmi ses membres, au scrutin secret, un secrétaire, un trésorier et un comptable.Article 6 Le Comité de gestion du Fonds se réunit une fois par mois pour examiner les comptes, les dépenses et les revenus du Fonds. Le Président a le droit d&#x27;inviter le Comité en cas de besoin. C&#x27;est celui qui organise le budget annuel et le présente à l&#x27;Assemblée générale pour approbation par l&#x27;intermédiaire du Conseil syndical. Le Comité du Fonds doit obtenir l&#x27;approbation de l&#x27;Assemblée générale pour toutes les questions à caractère préliminaire.Article 9 Le trésorier peut conserver dans son fonds une somme d&#x27;argent ne dépassant pas mille livres libanaises pour les cas d&#x27;urgence et les affaires urgentes, et il ne peut débourser aucune somme sauf sur décision du comité du fonds.Article 10 Les fonds du Fonds seront placés dans une banque désignée par le Comité de Gestion du Fonds, et aucune somme d&#x27;argent ne pourra être retirée sauf par une décision de ce Comité portant la signature du Président ou de son adjoint en son absence et la signature du Trésorier du Fonds. .Article 11 Le Comité de Gestion du Fonds fixe le budget annuel en novembre de chaque année et le présente à l&#x27;Assemblée Générale Ordinaire.Article 12 Le Comité de gestion du fonds, sous la supervision du ministère des Finances, organise, classe et détermine la quantité de timbres stipulée dans la présente loi. Personne ne peut vendre ces timbres sauf en vertu d&#x27;une licence obtenue du Comité de gestion du fonds.Article 13 Les timbres prévus par la présente loi sont soumis aux dispositions légales générales relatives aux timbres princiers en ce qui concerne leur invalidation, leur contrefaçon, leur vente sans autorisation du Syndicat, leur vente à un prix supérieur à leur valeur et autres infractions.Article 14 Pour chaque membre ayant atteint l&#x27;âge de soixante ans

Law of the Engineers&#x27; Retirement FundNo. 64/11Article 35Until it becomes possible to meet the legal conditions for retirement with regard to the period of registration in the Syndicate&#x27;s list in accordance with the provisions of this law, and at most until the end of the year 1976, the engineer participating in the Retirement Fund shall benefit from a retirement pension determined as follows:The full retirement pension if he has been registered in the Syndicate&#x27;s list for sixteen years without interruption. If the number of years of his registration is less than sixteen years, the retirement he is entitled to shall be part of the full retirement calculated in proportion to the number of years of his registration to sixteen. He shall not be entitled to retirement if the number of years of registration is less than eight years, provided that he has reached the age of sixty and has proven that he has worked in engineering in Lebanon after obtaining his degree for a period of no less than twenty-five years. This period shall be considered as starting from his registration in the Syndicate&#x27;s list, in addition to the period of practicing the profession before the year 1952, provided that the provisions of Article 17 of this law are observed. On the same basis, the engineer&#x27;s heirs shall also benefit from these provisions without being bound by the age condition and in accordance with Articles 18 and 19 of this law.Article 36This law shall be effective immediately upon its publication in the Official Gazette.

قانون الصندوق التقاعدي للمهندسينرقم 64/11 المادة 35 إلى أن يصبح من المكن توافر الشروط القانونية للتقاعد فيما يختص بمدة القيد في جدول النقابة عملا بأحكام هذا القانون ، وفي أقصى حد لغاية آخر سنة 1976 ، يستفيد المهندس المشترك في صندوق التقاعد من معاش تقاعدي يحدد كما يلي : كامل معاش التقاعد إذا كان قد مر على قيده في جدول النقابة ست عشرة سنة بدون انقطاع وإذا نقص عدد سنوات قيده عن ست عشرة سنة ، فيكون التقاعد الذي يستحقه جزءا من التقاعد الكامل يحسب بنسبة سنوات قيده إلى ستة عشر ولا يستحق التقاعد إذا نقص عدد سنوات القيد عن الثمان سنوات وذلك بشرط أن يكون قد بلغ الستين من العمر ، وأثبت أنه قد اشتغل بالهندسة في لبنان بعد نيله الشهادة مدة لا تقل عن خمس وعشرين سنة وتعتبر هذه المدة ابتداء من تسجيله في جدول النقابة مضافا إليها مدة مزاولة المهنة قبل سنة 1952 وبشرط مراعاة أحكام المادة 17 من هذا القانون ، وعلى نفس هذا الأساس أيضا يستفيد ورثة المهندس من هذه الأحكام دون التقيد بشرط السن ووفاقا للمادتين 18 و19 من هذا القانون . المادة 36 يعمل بهذا القانون فور نشره في الجريدة الرسمية .

La période d&#x27;exercice de la profession antérieure à l&#x27;année 1952, à condition de tenir compte des dispositions de l&#x27;article 17 de la présente loi, et sur cette même base, les héritiers de l&#x27;ingénieur bénéficient également de ces dispositions sans être limités par la condition d&#x27;âge et conformément aux articles 18 et 19 de la présente loi.Article 36 Cette loi entrera en vigueur dès sa publication au Journal officiel.

Engineering degrees are recognized by decisions issued by the Engineering Practice Committee referred to in Clause Five of this Article and approved by the Minister of Culture and Higher Education. It is absolutely not permissible to recognize degrees granted based on correspondence study.As for those who began their studies before the effective date of this law, the legal provisions that were in effect on the aforementioned date shall apply to them.2- He must have, on a date (prior to) commencing university studies leading to the engineering degree, a Lebanese Baccalaureate degree or its equivalent.3- He must not have been convicted of a felony or a disgraceful misdemeanor that deprives him of the right to vote.4- His name must be registered in the Engineers Syndicate’s register.5- He must have obtained a license to practice the engineering profession from the Ministry of Public Works in accordance with Article 5 of this law.Article 4The following conditions must be met by a non-Lebanese engineer:1- From Arab countries:A- He must meet the conditions set forth in Article 3 of this law.B- His country’s legislation treats Lebanese engineers in the same way.C- He must prove that he has the right to practice the engineering profession in his country of origin.D- He must have a residence card and work permit from the competent departments and that he actually resides in Lebanon.E- If he is a foreigner by origin and naturalized with the nationality of one of the Arab countries, five years must have passed since he acquired this nationality.2- From non-Arab countries:A- He must meet the conditions set forth in Article 3 of this law.B- That the legislation of his country treats Lebanese engineers in the same way.C- That at least ten years have passed since he obtained his engineering degree.D- That he be affiliated with the engineering organization in his home country if this affiliation is mandatory in order to practice the engineering profession there, and if it is not mandatory, he must prove that he has the right to practice the engineering profession in his home country.E- That he has a residence card and a work permit from the competent official departments and that he actually resides in Lebanon, and that he has obtained prior approval from the Engineers Syndicate.F- The registration application shall be submitted in accordance with Article Twelve of this law to the Syndicate Council, which, after verifying that the application has completed all legal conditions, has the right to decide whether to accept or reject the registration application. In the event of acceptance, the registration shall be for a limited period of one year, renewable based on the engineer’s request, provided that the Federal Council sets a schedule of the maximum number of registrations allowed for each specialty in light of the professional conditions of the Syndicate.3- Foreign engineers registered in the Syndicate and practicing the profession in Lebanon when this law is implemented are authorized to continue practicing it as before if they hold certificates and the laws of their countries allow Lebanese engineers to practice their profession there.Article 5A license to practice the engineering profession shall be granted by the Minister of Public Works based on a request attached to the engineering certificate and the statements proving the matters imposed in the previous articles and based on the proposal of a committee called the Engineering Practice Committee whose mission is to study the applications and engineering certificates and express its opinion on their compliance with the law and their technical and scientific value. This committee consists of:- The Minister of Culture and Higher Education or his delegate as “Chairman”.- The Chairman of the Council of the Lebanese Engineers Union or his delegate as “Member”.- An engineer delegated by the Ministry of Public Works of at least the second category, appointed by the Minister of Public Works as “Member”.- An engineer who is a professor at the Faculty of Engineering at the Lebanese University, appointed by the Minister of Culture and Higher Education based onthe proposal of the President of the Lebanese University as “Reporting Member”.When the student holds a degree in agricultural engineering, permission to practice the profession of agricultural engineering is granted by the Minister of Agriculture, and the representative of the Ministry of Public Works is replaced by an agricultural engineer, representative of the Ministry of Agriculture, of at least the second category, appointed by the Minister of Agriculture.In the event that the application is not decided upon within a maximum period of four months, the interested party has the right to refer to the Court of Appeal specified in Articles 13, 14 and 15 of this law.Article 6It is prohibited for

Les certificats d&#x27;ingénieur sont reconnus conformément aux décisions émises par le Comité pour l&#x27;exercice de la profession d&#x27;ingénieur visé à la cinquième clause du présent article et approuvées par le ministre de la Culture et de l&#x27;Enseignement supérieur. Il n&#x27;est absolument pas permis de reconnaître des certificats délivrés sur la base d&#x27;études par correspondance.Quant à ceux qui ont commencé leurs études avant la date d’entrée en vigueur de la présente loi, les dispositions légales qui étaient en vigueur à la date susvisée leur seront applicables.2- Il doit être titulaire, à une date antérieure de début d&#x27;études universitaires menant à un diplôme d&#x27;ingénieur, d&#x27;un baccalauréat libanais ou son équivalent.3- Il ne doit pas avoir été reconnu coupable d&#x27;un crime ou d&#x27;un délit odieux le privant du droit de vote.4- Son nom doit être inscrit au fichier du Syndicat des Ingénieurs.5- Il doit disposer d&#x27;une autorisation d&#x27;exercice de la profession d&#x27;ingénieur délivrée par le Ministère des Travaux Publics conformément à l&#x27;article Cinq de la présente loi.Article 4L&#x27;ingénieur non libanais doit :1- Depuis les pays arabes :A- Qu&#x27;il remplisse les conditions prévues à l&#x27;article trois de la présente loi.B- Que la législation de son pays traite de la même manière les ingénieurs libanais.C- Prouver qu&#x27;il a le droit d&#x27;exercer la profession d&#x27;ingénieur dans son pays d&#x27;origine.D- Il doit disposer d&#x27;une carte de séjour et d&#x27;un permis de travail délivrés par les services compétents et résider effectivement au Liban.E- S&#x27;il est d&#x27;origine étrangère et est naturalisé avec la nationalité d&#x27;un des pays arabes, cinq ans doivent s&#x27;être écoulés depuis qu&#x27;il a acquis cette nationalité.2- Pays non arabes :A- Qu&#x27;il remplisse les conditions prévues à l&#x27;article trois de la présente loi.B- Que la législation de son pays traite de la même manière les ingénieurs libanais.C- Au moins dix ans se sont écoulés depuis qu&#x27;il a obtenu son diplôme d&#x27;ingénieur.D- Il doit être affilié à l&#x27;organisme d&#x27;ingénierie de son pays d&#x27;origine si cette affiliation est obligatoire pour y exercer la profession d&#x27;ingénieur. Si cela n&#x27;est pas obligatoire, il doit justifier qu&#x27;il a le droit d&#x27;y exercer la profession d&#x27;ingénieur. pays d&#x27;origine.E- Il doit avoir une carte de séjour et un permis de travail délivrés par les services officiels compétents, et il doit résider effectivement au Liban, et doit avoir l&#x27;approbation préalable du Syndicat des Ingénieurs.F - La demande d&#x27;enregistrement doit être soumise conformément à l&#x27;article douze de la présente loi au Conseil du Syndicat qui, après avoir vérifié que la demande remplit toutes les conditions légales, a le droit de décider d&#x27;accepter ou de rejeter la demande d&#x27;enregistrement. En cas d&#x27;acceptation, l&#x27;inscription est pour une durée limitée d&#x27;un an, renouvelable à la demande de l&#x27;ingénieur. Le Conseil fédéral fixe un calendrier du nombre maximum d&#x27;inscriptions admissible pour chaque spécialité en fonction des conditions professionnelles du syndicat. .3- Les ingénieurs étrangers inscrits au syndicat et qui exercent la profession au Liban au moment de l&#x27;entrée en vigueur de cette loi sont autorisés à continuer à l&#x27;exercer comme avant s&#x27;ils sont titulaires de certificats et que les lois de leur pays autorisent les ingénieurs libanais à y exercer leur profession.Article 5L&#x27;autorisation d&#x27;exercer la profession d&#x27;ingénieur est accordée par le ministre des Travaux publics sur la base d&#x27;une demande annexée au certificat d&#x27;ingénieur et des déclarations confirmant les matières imposées aux articles précédents et sur proposition d&#x27;un comité appelé Comité pour l&#x27;exercice de la profession d&#x27;ingénieur. Profession d&#x27;Ingénieur dont la mission est d&#x27;étudier les candidatures et les certificats d&#x27;ingénieur et d&#x27;exprimer son avis sur leur conformité à la loi et leur valeur technique et scientifique. Cette commission est composée de :- Le Ministre de la Culture et de l&#x27;Enseignement Supérieur ou son « Président » désigné.- Président du Conseil de la Fédération des Ingénieurs Libanais ou son membre désigné (membre).- Un ingénieur représentant du Ministère des Travaux Publics de deuxième catégorie au moins, désigné par le Ministre des Travaux Publics comme « membre ».- Professeur ingénieur à la Faculté d&#x27;Ingénierie de l&#x27;Université Libanaise, nommé par le Ministre de la Culture et de l&#x27;Enseignement Supérieur comme ingénieur constructifSur proposition du Président de l’Université Libanaise, « Membre Rapporteur ».Lorsque l&#x27;étudiant est titulaire d&#x27;un diplôme d&#x27;ingénieur agronome, l&#x27;autorisation est accordée d&#x27;exercer la profession d&#x27;ingénieur agronome par le Ministre chargé de l&#x27;Agriculture, et le représentant du Ministère des Travaux Publics est remplacé par un ingénieur agronome, au moins un représentant de deuxième catégorie du Ministère de l&#x27;Agriculture, nommé par le ministre de l&#x27;Agriculture.Si la demande n&#x27;est pas statuée dans un délai maximum de quatre mois, l&#x27;intéressé a le droit de saisir la Cour d&#x27;appel prévue aux articles 13, 14 et 15 de la présente loi.Article 6Il est interdit de

بيروت وطرابلس تضمان المهندسين المرخص لهم بمزاولة مهنة الهندسة في الجمهورية اللبنانية.تتألف نقابة طرابلس من المهندسين المقيدين في محافظة لبنان الشمالي وتتألف نقابة بيروت من المهندسين المقيدين في سائر الانحاء اللبنانية.ب- يستثنى من احكام هذا القانون المهندسون الداخليون (Interior Architects)والمهندسون الفنيون (Technical Engineers) الذين سوف يوضع قانون خاص لكل منهما.المادة 2مع مراعاة احكام البند (ب) من المادة الاولى من هذا القانون، لا يحق لاحد ان يمارس مهنة الهندسة في لبنان اذا لم يكن اسمه مسجلاً في احدى النقابتين.المادة 3يشترط في المهندس اللبناني:1-أ- المتخرج من لبنان:ان يكون حائزاً على شهادة في الهندسة من جامعة او معهد مرخص له بتدريس الهندسة في لبنان.ب- المتخرج من خارج لبنان:ان يكون حائزاً على شهادة في الهندسة من جامعة او معهد معترف بشهادته من الحكومة اللبنانية وان يكون برنامج الدراسة المؤدي لشهادة الهندسة او عدد الوحدات (Credits) يعادل مناهج الدراسة في الجامعة اللبنانية بعد البكالوريا اللبنانية القسم الثاني او ما يعادلها او على شهادة في الهندسة بدرجة ماجستير. يتم الاعتراف بالشهادات الهندسية بموجب قرارات تصدرها لجنة مزاولة مهنة الهندسة المشار اليها في البند الخامس من هذه المادة ويصادق عليها وزير الثقافة والتعليم العالي. ولا يجوز مطلقاً الاعتراف بالشهادات المعطاة بناء على دراسة بالمراسلة.اما الذين بدأوا دراساتهم قبل تاريخ العمل بهذا القانون، فتطبق عليهم الاحكام القانونية التي كانت مرعية الاجراء بالتاريخ المذكور.2- ان يكون حائزا بتاريخ (سابق) لمباشرة الدراسة الجامعية المؤدية لشهادة الهندسة على شهادة البكالوريا اللبنانية او ما يعادلها.3- ان لا يكون محكوماً عليه بجناية او جنحة من الجنح الشائنة التي تحرم من حق الانتخاب.4- ان يكون قد سجل اسمه في جدول نقابة المهندسين.5- ان يكون حاصلاً على اذن مزاولة لمهنة الهندسة من وزارة الاشغال العامة وفقاً للمادة الخامسة من هذا القانون. المادة 4يشترط في المهندس غير اللبناني:1- من ابناء الدول العربية:أ- ان تتوفر فيه الشروط المبينه في المادة الثالثة من هذا القانون.ب- ان تعامل تشريعات بلاده المهندسين اللبنانيين بالمثل.ج- ان يثبت انه يتمتع بحق ممارسة مهنة الهندسة في بلده الاصلي.د- ان يكون حائزاً على بطاقة اقامة واجازة عمل من الدوائر المختصة وان يقيم فعلاً في لبنان.هـ- اذا كان اجنبي الاصل ومتجنساً بجنسية احدى الدول العربية، ان تكون قد مضت خمس سنوات على اكتسابه هذه الجنسية.2- من غير ابناء الدول العربية:أ- ان تتوافر فيه الشروط المبينه في المادة الثالثة من هذا القانون.ب- ان تعامل تشريعات بلاده المهندسين اللبنانيين بالمثل.ج- ان يكون قد انقضى على نيله شهادة الهندسة عشر سنوات على الاقل.د- ان يكون منتسباً للتنظيم الهندسي في بلده الاصلي اذا كان هذا الانتساب الزامياً لاجل مزاولة مهنة الهندسة فيه، وفي حال عدم الزامية ذلك عليه ان يثبت انه يتمتع بحق ممارسة مهنة الهندسة في بلده الاصلي.هـ- ان يكون حائزاً على بطاقة اقامة واجازة عمل من الدوائر الرسمية المختصة وان يقيم فعلاً في لبنان، وان يكون حاصلاً على الموافقة المسبقة من نقابة المهندسين.و- يقدم طلب القيد وفاقاً للمادة الثانية عشرة من هذا القانون الى مجلس النقابة الذي يعود له بعد تثبتـه من استكمـال الطلب لكافـة الشروط القانونية، حق التقدير لجهة قبـول طلب القيد او رفضه وفي حال القبول يكون القيد لمدة محدودة بسنة واحدة قابلة للتجديد بناء لطلب المهندس، على ان يضع المجلس الاتحادي جدولاً بالحد الاعلى للقدر المسموح به للقيد بكل اختصاص في ضوء الاوضاع المهنية للنقابة.3- يرخص للمهندسين الاجانب المسجلين في النقابة والذين يزاولون المهنة في لبنان عند العمل بهذا القانون بمتابعة مزاولتها كالسابق اذا كانوا من حملة الشهادات وكانت قوانين بلادهم تبيح للمهندسين اللبنانيين مزاولة مهنتهم فيها.المادة 5يعطى اذن مزاولة مهنة الهندسة من قبل وزير الاشغال العامة بناء على طلب مرفق بالشهادة الهندسية وبالافادات المثبتة للامور المفروضة في المواد السابقة وبناء على اقتراح لجنة تدعى لجنة مزاولة مهنة الهندسة مهمتها درس الطلبات والشهادات الهندسية وابداء رأيها في مطابقتها للقانون وفي قيمتها الفنية والعلمية وهذه اللجنة قوامها:- وزير الثقافة والتعليم العالي او من ينتدبه «رئيساً».- رئيس مجلس اتحاد المهندسين اللبنانيين او من ينتدبه «عضواً».- مهندس مندوب عن وزارة الاشغال العامة من الفئة الثانية على الاقل يسميه وزير الاشغال العامة «عضواً».- مهندس استاذ في كلية الهندسة في الجامعة اللبنانية يسميه وزير الثقافة والتعليم العالي بناء على اقتراح رئيس الجامعة اللبنانية «عضوا مقررا».وعندما يكون الطالب يحمل شهادة في الهندسة الزراعية يعطى الإذن بمزاولة مهنة الهندسة الزراعية من قبل وزير الزراعة ويستعاض عن مندوب وزارة الاشغال بمهندس زراعي مندوب عن وزارة الزراعة من الفئة الثانية على الاقل يسميه وزير الزراعة.وفي حال عدم البت بالطلب خلال مهلة اقصاها اربعة اشهر، حق لصاحب العلاقة ان يراجع محكمة الاستثناف المحددة في المواد 13و14و15 من هذا القانون.المادة 6يحظر على المهندسين المنتسبين والذين يستوفون شروط الانتساب الى نقابة المهندسين،انشاء اي جمعية هندسية تتعاطى العمل النقابي خارج نطاق النقابة ولا تدخل جمعيات او رابطات خريجي المعاهد الهندسية ضمن الهيئات او الجمعيات المنوه عنها في هذه المادة.المادة 7كل من يزاول مهنة الهندسة بغير حق او ينتحل لنفسه صفة مهندس يتعرض للعقوبات المنصوص عنها في المادة 393 من قانون العقوبات.

Chapter Two: Organizing the Engineers SyndicateChapter One: The Syndicate&#x27;s PurposeArticle 8The mission of the Engineers Syndicate is professional, scientific, administrative, and social. Its purpose is:1- Raising the status of the engineering profession and improving its scientific level to play its constructive role in the fields of development, reconstruction, and society.2- Raising the status of the engineering profession and preserving their legitimate moral and material rights and interests and ensuring the moral duties of the engineering profession and its dignity.3- Seeking to resolve disputes that arise between engineers or between them and their clients.4- Monitoring the discipline of engineers and taking the necessary disciplinary measures against engineers who violate the law on practicing the profession, the Syndicate&#x27;s regulations, and the professional&#x27;s moral duties.5- Assisting needy and disabled engineers or their families and exercising all powers of the Syndicate with regard to the retirement fund established by Law No. 11/64 dated February 19, 1964 and amended by Decree No. 9805 dated May 4, 1968.6- Expressing an opinion on draft laws and regulations related to the engineering profession upon the request of the competent minister.7- Submitting proposals regarding engineering curricula in engineering colleges and institutes in Lebanon.8- Submitting proposals regarding technical specifications, standard regulations, general and model specifications for works.9- Establishing a center to collect and document information related to all activities of the engineering profession and materials used in various engineering fields and facilitating their provision to those who wish.10- Establishing scientific libraries in the Syndicate’s headquarters or branches, activating, translating and publishing engineering and scientific books, and issuing periodic and non-periodic bulletins.11- Conducting educational and training courses for engineers.12- Holding conferences, seminars and lectures and participating in conferences, seminars and engineering and scientific lectures inside and outside the Lebanese Republic.13- Participating with Arab and international engineering organizations in all matters related to the engineering profession.14- Expressing an opinion on organizing auxiliary professions in the field of engineering upon the request of the competent minister.15- Establishing a guide for tariffs and collecting fees.16- Finding a self-insurance formula.17- Establishing private clubs, housing and consumer cooperatives for engineers and a mutual fund in accordance with the applicable laws.18- The Syndicate shall carry out all the work that achieves its stated objectives within the limits of the applicable laws and regulations.Article 9In order to enable the Syndicate to collect its due fees, public and private administrations and institutions shall provide it with a statement on the amount of fees due to engineers or engineering companies registered with the Syndicate in the contracts in force with them for each engineering work, whether in the study, supervision or implementation phase.Article 10Each of the two syndicates shall enjoy a legal personality and financial and administrative independence. Each of them shall have the right to own the real estate necessary to practice its activity and manage its funds and business, and the real estate whose proceeds are allocated to feed the Social Benefits Fund and the Retirement Fund established pursuant to the law issued on February 19, 1964 and amended by Decree No. 9805 dated May 4, 1968, and to contribute to non-profit public benefit institutions, all within the limits of the applicable laws and regulations.Chapter Two: The Lebanese Engineers UnionArticle 11The two engineers’ unions in Lebanon shall form a union called the Lebanese Engineers Union, which shall have a council consisting of the President of the Engineers’ Union in Beirut as President, the Engineers’ Union in Tripoli as Vice President, two members from the Beirut Syndicate Council, and one member from the Tripoli Syndicate Council.The mission of this council shall be:1- Taking care of engineering issues.2- External communications.3- Taking care of local and international engineering conferences.4- Coordinating the work of the two syndicates.5- Deciding on all pending matters between the two unions or their members that concern the two unions. The Federal Council shall have a general body consisting of the two councils in Beirut and Tripoli. Its mission shall be to prepare the union’s budget and propose amendments to the union’s internal regulations.Chapter Three: Registration ProceduresArticle 12Anyone who requests to register his name in the union’s roster must meet all the conditions required to practice the engineering profession in accordance with the applicable laws and union regulations. Registration requests shall be submitted to the relevant union council. The applicant must state in his application his name, surname, nationality, date of birth, name of the institute from which he graduated, date of obtaining the degree, academic titles, place of residence, place of practice of his profession, number and date of the Ministry of Culture and Higher Education’s permit as appropriate, and attach all supporting documents to his application. He must also attach the registration fee, annual subscription fee, and various union fees to the application.Article 13The Syndicate Council shall decide on the registration application with a reasoned decision within two months from the date of its submission, whether to accept or reject it. If the aforementioned period has passed since the application was submitted without a decision being made on it, whether to accept it or if the application is rejected, the applicant has the right to appeal to the Court of Appeal, Civil Chamber, in the governorate in which the Syndicate headquarters to which he wishes to belong is located.Article 14The appeal shall be submitted to the Court of Appeal, Civil Chamber, in the governorate within a period of thirty days from the date the applicant for registration is notified of the rejection decision or from the date of expiry of the two months referred to in the previous article. Immediately after submitting the appeal to the Court of Appeal, the applicant’s file shall be requested from the Syndicate Council, and the Council shall send it within a period of two weeks at most, along with the comments it deems appropriate to make.Article 15Two members of the Syndicate Council appointed by the President shall join the Court of Appeal when considering registration requests. If one or both of the Syndicate representatives are unable to attend or are not appointed, the Court of Appeal in its regular session may decide on the appeal. The Court’s decision shall be final and not subject to any ordinary or exceptional appeal, except for objection to the judgment in absentia.Chapter Four: Organization and Administration of the SyndicateArticle 16The Engineers Syndicates in Beirut and Tripoli shall each consist of all the engineers affiliated with it and whose name is registered.

Chapter Three: Rights and Duties of EngineersArticle 53The engineer has the right to a fee for the work he performs within the scope of his profession. The engineer&#x27;s fee shall be determined by agreement with his assignor, in accordance with the technical and administrative conditions specified by the Syndicate in the internal regulations.Article 54No judicial decision to seize maps or any engineering documents from an engineering office shall be implemented until at least twenty-four hours have passed since a copy of it has been deposited at the headquarters of the Syndicate to which he belongs, with an invitation addressed to the Syndicate to attend the proceedings in person or through his delegate.Except in the case of a flagrant crime, an engineer shall not be interrogated about a crime attributed to him, resulting from the practice of the profession, before the matter is reported to the Syndicate of Engineers, who has the right to attend the interrogation in person or through his delegate.Article 55The engineer must observe accuracy, honesty and the rules of the art in his professional work and must maintain the dignity of the profession in his work and actions and must abide in all circumstances by the principles of honor, integrity and honesty and refrain from doing work that degrades the dignity of the profession.Article 56The engineer is prohibited, in his practice of engineering work as a liberal profession, from seeking to solicit work and attract clients by any means of enticement or brokerage. If the engineer advertises himself in newspapers or other publications, he may only mention his name, address and specialty in brief.Article 57Engineers may establish companies to practice the engineering profession. The partnership deed must be in writing and registered with the Engineers Syndicate with all amendments made to it after its registration in the commercial register.These companies shall be registered in a special table with the Syndicate in accordance with a system established by the Syndicate Council.

الباب الثالث : في حقوق المهندسين وواجباتهمالمادة 53للمهندس الحق ببدل اتعاب عن الاعمال التي يقوم بها ضمن نطاق مهنته، يحدد بدل اتعاب المهندس باتفاق يعقده مع مكلفه، وذلك وفقاً للشروط الفنية والادارية التي تحددها النقابة في النظام الداخلي.المادة 54لا ينفذ اي قرار قضائي، يقضي بحجز خرائط او اية مستندات هندسية من مكتب هندسي الا بعد انقضاء اربع وعشرين ساعة على الاقل على ايداع صورة عنه مركز النقابة التي ينتمي اليها مع دعوة موجهة للنقيب لحضور الاجراءات بنفسه او بواسطة من ينتدبه.باستثناء حالة الجرم المشهود، لا يستجوب مهندس عن جريمة منسوبة اليه، ناتجة عن ممارسة المهنة، قبل ابلاغ الامر الى نقيب المهندسين الذي يحق له حضور الاستجواب بنفسه او بواسطة من ينتدبه.المادة 55على المهندس ان يراعي في اشغاله المهنية الدقة والامانة وقواعد الفن وان يحافظ في اعماله وتصرفاته على كرامة المهنة وان يتقيد في جميع الظروف بمبادىء الشرف والاستقامة والنزاهة وان يمتنع عن القيام بالاشغال التي تحط من كرامة المهنة.المادة 56يحظر على المهندس في تعاطيه اعمال الهندسة كمهنة حرة ان يسعى في استجداء الاشغال وجلب الزبائن بأية طريقة من طرق الترغيب والسمسرة، واذا اعلن المهندس عن نفسه في الجرائد او النشرات الاخرى فلا يجوز له ان يذكر سوى اسمه وعنوانه واختصاصه باختصار.المادة 57للمهندسين ان ينشؤا شركات لممارسة مهنة الهندسة. يجب ان يكون صك الشراكة خطياً وان يسجل لدى نقابة المهندسين مع جميع التعديلات التي تطرأ عليه بعد تسجيلها في السجل التجاري.تسجل هذه الشركات في جدول خاص لدى النقابة وفقاً لنظام يضعه مجلس النقابة.

Chapter Four: Engineers&#x27; DisciplineArticle 58The Disciplinary Council shall consist of the President or his deputy as Chairman and four members from different branches elected by the General Assembly for a period of three years, renewable once.The General Assembly shall also elect three alternate members to replace the original members by a decision of the President.Candidates for membership in the Disciplinary Council shall have been registered in the Syndicate for fifteen years.Article 59Members of the Disciplinary Council or one of them may be dismissed if there is a reason for dismissing judges stipulated in the Code of Civil Procedure.The Syndicate Council shall consider the dismissal request and decide on it in accordance with the principles of dismissing judges.Chapter Two: PenaltiesArticle 60The Syndicate of Engineers may issue a warning to an engineer in the event of a minor violation by him without referring him to the disciplinary board.Article 61Any engineer who fails to fulfill his professional duties or commits an act during or outside the practice of the profession that degrades its value or behaves in a manner that is inconsistent with its dignity or exposes his dignity or the dignity of his colleagues to what affects honor, integrity or competence or affects the honor of the syndicate to which he belongs by his behavior shall be subject to the following disciplinary penalties:1- Warning2- Reprimand3- Prohibition from practicing all or some engineering work for a period not exceeding three years.4- Deletion from the Syndicate’s list and permanent prohibition from practicing the profession.Article 62The period of temporary prohibition from practicing all engineering work shall not be included in the calculation of the retirement period and other periods specified for assuming syndicate tasks and positions.Article 63The employee engineer shall be subject to the General Disciplinary Council for Employees, and shall not be subject to disciplinary action except before this Council, and the legal and regulatory provisions relating to the aforementioned Council shall apply to him.The Syndicate President, after the approval of the Syndicate Council, may propose to the administration to which the employee engineer belongs to refer the latter to the General Disciplinary Council for Employees when he deems it necessary, and the matter of deciding on the matter shall be referred to the competent administration.Chapter Three: Procedural Procedures and Methods of ReviewArticle 64The Syndicate President shall refer disciplinary violations after investigating them to the Disciplinary Council on his own initiative or:1- Based on a complaint from the concerned administration or the Public Prosecution Office or one of the affected engineers or others.2- Based on the request of the engineer who sees himself the subject of an unjust accusation, his case shall be submitted spontaneously to the discretion of the Disciplinary Council.Article 65The separation of the engineer from practicing the profession does not prevent him from being subject to disciplinary action for acts committed before his separation.Article 66The Disciplinary Board shall follow the principles of a secret trial. When appointing the engineer, it shall take into consideration his good faith and may refer to all means of proof. The Disciplinary Board may seek the assistance of a legal advisor to attend the trial sessions and provide advice on all aspects of the Board’s jurisdiction.The defendant engineer shall be invited to the trial and heard. The engineer shall comply with the request, answer the questions directed to him and provide the clarifications requested of him.He may seek the assistance of a lawyer or one engineer or both together to defend him.The Disciplinary Board’s decisions shall be taken by majority vote.Article 67The Disciplinary Board shall issue its decision within two months from the date of the complaint.If it does not, the President and the Public Prosecution Office shall have the right to transfer the case to the Civil Court of Appeal, which shall consider it in the final instance.Disciplinary decisions shall be subject to appeal within ten days from the date of notification.Notification shall be made in person by registered letter with acknowledgment of receipt.The appeal shall be submitted and decided upon after two members of the Syndicate Council join the court. If this is not possible, the court in its regular session shall decide on the review.Article 68Anyone who has been issued a disciplinary ruling that permanently removes his name from the Syndicate’s register shall have the right to request the Syndicate Council, after five full years have passed since the issuance of that ruling, to re-register his name in the Syndicate’s register. If the Council deems that the period that has passed is sufficient to remove the effect of what he has done, it shall decide to re-register his name. If the Council rejects the request, it may not be renewed except after two years have passed, and the request may not be renewed after it has been rejected twice.Article 69The Syndicate Council shall, based on the proposal of the President, take all necessary measures to implement the decision and announce it where necessary.Article 70Civil prosecution or criminal prosecution does not prevent disciplinary prosecution if its conditions are met.

الباب الرابع : في انضباط المهندسينالمادة 58يتألف المجلس التأديبي من النقيب او نائبه رئيساً ومن اربعة اعضاء من فروع مختلفة تنتخبهم الهيئة العامة لمدة ثلاث سنوات قابلة للتجديد مرة واحدة.كمـا تنتخـب الهيئـة العامـة ثلاثــة اعضـاء ردفــاء يحلون محل الاعضـاء الاصيلين بقــرار من النقيب.يشترط في المرشحين لعضوية المجلس التأديبي ان يكون قد مضى على تسجيلهم في النقابة خمسة عشر سنة.المادة 59يجـوز رد اعضـاء المجلـس التأديبـي او احدهـم عند وجـود سبـب من اسبـاب رد القضـاة المنصوص عليها في قانون اصول المحاكمات المدنيـة.ينظر في طلب الرد مجلس النقابة ويفصل فيه وفقاً لاصول رد القضاة.الفصل الثاني : في العقـوبـاتالمادة 60لنقيب المهندسين ان يوجه تنبيها الى احد المهندسين عند وقوع مخالفة بسيطة من قبله دون احالته الى المجلس التأديبي.المادة 61كل مهندس يخل بواجبات مهنته او يقدم اثناء مزاولة المهنة او خارجاً عنها على عمل يحط من قدرها او يسلك مسلكاً لا يأتلف وكرامتها او يعرض كرامته او كرامة زملائه لما يمس الشرف او الاستقامة او الكفاءة او يمس بسلوكه شرف النقابة التي ينتمي اليها يتعرض للعقوبات التأديبية الآتية:1- التنبيه2- اللوم3- المنع من مزاولة جميع الاعمال الهندسية او بعضها لمدة لا تتجاوز الثلاث سنوات.4- الشطب من جدول النقابة والمنع من مزاولة المهنة نهائياً.المادة 62ان مدة المنع المؤقت من مزاولة جميع الاعمال الهندسية لا تدخل في حساب مدة التقاعد وسائر المدد المعينة لتولي المهام والمراكز النقابية.المادة 63يخضع المهندس الموظف للمجلس التأديبي العام الخاص بالموظفين، ولا يلاحق تأديبياً الا امام هذا المجلس وتطبق عليه الاحكام القانونية والتنظيمية المتعلقة بالمجلس المذكور.للنقيب بعد موافقة مجلس النقابةان يقترح على الادارة التابع اليها المهندس الموظف احالة هذا الاخير على المجلس التأديبي العام الخاص بالموظفين عندما يرى موجباً لذلك ويعود امر البت في الموضوع للادارة المختصة.الفصل الثالث : في اصول المحاكمات وطرق المراجعةالمادة 64يحيل النقيب المخالفات المسلكية بعد التحقيق فيها على مجلس التأديب من تلقاء نفسه او:1- بناء على شكوى من الادارة المعنية او النيابة العامة الاستئنافية او احد المتضررين من المهندسين او سواهم.2- بنـاء على طلب المهندس الذي يرى نفسـه موضع تهمـة غير محقـة فيعرض امـره عفـواً لتقدير مجلس التأديب.المادة 65ان انفصال المهندس عن ممارسة المهنة لا يمنع محاكمته تأديبياً على افعال ارتكبها قبل انفصاله.المادة 66يتبع مجلس التأديب اصول محاكمة سرية. وله عند تعيين مسؤولية المهندس ان يأخذ بعين الاعتبار حسن نيته كما له ان يرجع الى جميع طرق الاثبات، ولمجلس التأديب ان يستعين بمستشار قانوني لحضور جلسات المحاكمة ولابداء المشورة في كافة نواحي اختصاص المجلس.يجب دعوة المهندس المدعى عليه الى المحاكمة والاستماع اليه. وعلى المهندس ان يلبي الطلب وان يجيب على الاسئلة التي توجه اليه وان يعطي الإيضاحات التي تطلب منه.وله ان يستعين بمحام او مهندس واحد او بكليهما معاً للدفاع عنه.تتخذ قرارات المجلس التأديبي بالاكثرية.المادة 67على مجلس التأديب ان يصدر قراره خلال شهرين من تاريخ الشكوى.واذا خالف ذلك، يحق لكل من النقيب والنيابة العامة الاستئنافية ان تنقل القضية الى محكمة الاستئناف المدنية فتنظر فيها بالدرجة الاخيرة.تقبل القرارات التأديبية الاستئناف في مدة عشرة ايام من تاريخ تبليغها.يجري التبليغ شخصياً بكتاب مضمون مع اشعار بالوصول.يقدم الاستئناف ويحكم به بعد ان ينضم الى المحكمة عضوان من مجلس النقابة واذا تعذر ذلك كان للمحكمة بهيئتها العادية ان تبت بالمراجعة.المادة 68يحق لمن صدر حكم تأديبي يشطب اسمه نهائياً من جدول النقابة ان يطلب الى مجلس النقابة بعد مضي خمس سنوات كاملة على ابرام ذلك الحكم اعادة تسجيل اسمه في جدول النقابة. فاذا رأى المجلس ان المدة التي مضت كافية لازالة اثر ما وقع منه قرر إعادة تسجيل اسمه واذا رفض المجلس الطلب فلا يجوز تجديده الا بعد مرور سنتين ولا يجوز تجديد الطلب بعد رفضه مرتين.المادة 69يتخذ مجلس النقابة بناء على اقتراح النقيب جميع الاجراءات اللازمة لاجل تنفيذ القرار واعلانه حيث تدعو الحاجة.المادة 70ان الملاحقة المدنية او التعقبات الجزائية لا تمنع الملاحقة المسلكية في حال توفر شروطها.

Chapitre quatre : De la discipline des ingénieursArticle 58Le Conseil de Discipline est composé du Président ou de son adjoint en qualité de Président et de quatre membres issus de différentes branches élus par l&#x27;Assemblée Générale pour une durée de trois ans renouvelable une fois.L&#x27;Assemblée Générale élit également trois membres suppléants pour remplacer les membres originaux sur décision du Capitaine.Les candidats à l&#x27;adhésion au Conseil de discipline doivent être inscrits au syndicat depuis quinze ans.Article 59Les membres du Conseil de discipline, ou l&#x27;un d&#x27;entre eux, peuvent être révoqués s&#x27;il existe l&#x27;un des motifs de révocation des juges prévus au Code de procédure civile.Le Conseil Syndical examine la demande de récusation et statue sur celle-ci conformément aux principes de récusation par les juges.Chapitre deux : Des punitionsArticle 60Le chef des ingénieurs peut adresser un avertissement à l&#x27;un des ingénieurs lorsqu&#x27;une infraction mineure survient de sa part sans le référer au conseil de discipline.Article 61Tout ingénieur qui viole les devoirs de sa profession, ou accomplit, pendant ou hors de l&#x27;exercice de la profession, un travail qui en dégrade la valeur, ou se livre à un comportement incompatible avec sa dignité, ou expose sa dignité ou celle de ses confrères de manière d&#x27;une manière qui porte atteinte à l&#x27;honneur, à l&#x27;intégrité ou à la compétence, ou dont la conduite porte atteinte à l&#x27;honneur du syndicat auquel il appartient, est passible des sanctions disciplinaires suivantes :1- Alerte2- Le blâme3- Interdiction d&#x27;exercer tout ou partie des travaux d&#x27;ingénierie pour une durée n&#x27;excédant pas trois ans.4- Radiation du syndicat et interdiction définitive d’exercer la profession.Article 62La période d&#x27;interdiction temporaire d&#x27;exercer tous travaux d&#x27;ingénierie n&#x27;est pas incluse dans le calcul de la période de retraite et des autres périodes prévues pour l&#x27;exercice de tâches et de fonctions syndicales.Article 63L&#x27;ingénieur salarié est soumis au Conseil Général de Discipline des Salariés, et il n&#x27;est soumis à des mesures disciplinaires que devant ce Conseil, et les dispositions légales et réglementaires liées audit Conseil précité lui sont appliquées.Le président, après l&#x27;approbation du conseil syndical, peut proposer à l&#x27;administration à laquelle appartient l&#x27;ingénieur salarié de renvoyer ce dernier au Conseil général de discipline des salariés lorsqu&#x27;il l&#x27;estime nécessaire, et la question de trancher en la matière. retourne à l&#x27;administration compétente.Chapitre trois : Sur les principes des essais et les méthodes d&#x27;examenArticle 64Le Capitaine devra déférer les violations disciplinaires après enquête au Conseil de Discipline de sa propre initiative ou :1- Sur base d&#x27;une plainte émanant de l&#x27;administration concernée, du parquet d&#x27;appel, ou de l&#x27;un des ingénieurs concernés ou autres.2- À la demande de l&#x27;ingénieur qui s&#x27;estime faire l&#x27;objet d&#x27;une accusation injustifiée, son dossier est librement soumis à la discrétion du Conseil de discipline.Article 65La cessation de l’exercice de la profession de l’ingénieur ne l’empêche pas d’être jugé disciplinairement pour les actes qu’il a commis avant sa cessation.Article 66Le Conseil de Discipline suit les principes d&#x27;un procès secret. Lors de l&#x27;attribution de la responsabilité à l&#x27;ingénieur, celui-ci pourra tenir compte de sa bonne foi et pourra se référer à tous les moyens de preuve, et le Conseil de discipline pourra solliciter l&#x27;assistance d&#x27;un conseiller juridique pour assister aux audiences du procès et donner des conseils sur tous les aspects de la compétence du Conseil. .L&#x27;ingénieur défendeur doit être convoqué au procès et entendu. L&#x27;ingénieur doit répondre à la demande, répondre aux questions qui lui sont adressées et donner les éclaircissements qui lui sont demandés.Il peut demander l&#x27;assistance d&#x27;un avocat, d&#x27;un ingénieur ou des deux pour se défendre.Les décisions du Conseil de Discipline sont prises à la majorité.Article 67Le Conseil de Discipline doit rendre sa décision dans un délai de deux mois à compter de la date de la réclamation.Si ce n&#x27;est pas le cas, tant le capitaine que le parquet d&#x27;appel ont le droit de transférer l&#x27;affaire devant la Cour d&#x27;appel civile pour qu&#x27;elle l&#x27;examine au niveau final.Les décisions disciplinaires sont susceptibles d&#x27;appel dans un délai de dix jours à compter de la date de leur notification.La notification s&#x27;effectue personnellement, par lettre recommandée avec avis d&#x27;arrivée.Le recours sera introduit et statué après l&#x27;entrée au tribunal de deux membres du Conseil Syndical. Si cela n&#x27;est pas possible, le tribunal en séance ordinaire peut statuer sur la révision.Article 68Quiconque a fait l’objet d’une décision disciplinaire radiant définitivement son nom de la liste du syndicat a le droit de demander au conseil du syndicat, cinq ans après la conclusion de cette décision, de réinscrire son nom sur la liste du syndicat. Si le Conseil estime que le délai écoulé est suffisant pour faire disparaître les traces de ce qui lui est arrivé, il décide de réenregistrer son nom. Si le Conseil rejette la demande, celle-ci ne pourra être renouvelée qu&#x27;après un délai de deux ans, et. la demande ne peut être renouvelée après avoir été rejetée deux fois.Article 69Sur proposition du Président, le Conseil Syndical prendra toutes les mesures nécessaires pour mettre en œuvre la décision et la publiera le cas échéant.Article 70Les poursuites civiles ou pénales n’empêchent pas les poursuites pénales si leurs conditions sont remplies.

Chapter Five: Various ProvisionsArticle 71The Engineers&#x27; Retirement Fund is subject to Law No. 11/64 issued on 2/19/1964.Article 72The Social Benefits Fund is subject to the internal regulations and any other special regulations established by the Syndicate Council. Its resources shall consist of the following:1- Fees approved by the Delegates&#x27; Authority.2- Donations.Article 73The Syndicate Council&#x27;s papers and decisions shall be communicated to the concerned parties either personally or by registered mail with acknowledgement of receipt or by a notary public. In the event that this is not possible, by any other means decided by the Syndicate Council or stipulated by the Code of Civil Procedure. Taking into account the special provisions contained in this law. Papers of invitations to attend or trial, whatever they may be, may be communicated by registered telegram with acknowledgement of receipt.Article 74The Engineering Profession Regulation Law issued on January 22, 1951 and its amendments and other legislative texts that contradict this law or are inconsistent with its provisions are hereby repealed.Article 75Transitional provisions:A- Upon the issuance of this law, the Syndicate Council shall draft a new internal regulation within a period of four months and present it to the current General Assembly of the Syndicate for approval or amendment within a period of two months at most. The internal regulation must be accompanied by the approval of the Minister of Public Works.B- The current Syndicate Council shall call for the election of members of the Delegates’ Body in accordance with the provisions of this law and the provisions of the new internal regulation.C-1- The existing Syndicate Council shall automatically continue until the first electoral cycle held by the General Assembly in the first election held pursuant to this law. Four members whose term in the old council has ended shall be elected in each of the Beirut and Tripoli Syndicates, where the rest shall continue their term in succession.2- In the first electoral cycle, the members of the Council shall be completed by electing three new members for the Beirut Syndicate, provided that a draw shall be held among the three successful members, the first of whom shall serve for one year, the second for two years, and the last for three years.D- The term of the current president shall be determined for a period of three years from the date of his election and shall continue until the electoral cycle in March 1999. In accordance with this law, the General Assembly shall elect, in the same cycle, a member to replace the president to complete his term of membership in the Syndicate Council. Article 76 This law shall be effective immediately upon its publication in the Official Gazette.

Chapitre cinq : Dispositions diversesArticle 71La Caisse de Retraite des Ingénieurs est soumise à la loi n° 11/64 du 19/02/1964.Article 72La Caisse des Prestations Sociales est soumise au règlement intérieur et à tout autre règlement particulier établi par le Conseil Syndical, et ses ressources sont constituées comme suit :1- Tarifs approuvés par le corps des délégués.2- Dons.Article 73Les actes et décisions du Conseil Syndical sont communiqués aux intéressés, soit personnellement, par lettre recommandée avec avis d&#x27;arrivée, soit par notaire. Si cela n&#x27;est pas possible, par tout autre moyen décidé par le Conseil du Syndicat ou prévu au Code de procédure civile. Compte tenu des dispositions particulières contenues dans cette loi. Les convocations à comparaître ou à juger, quelles qu&#x27;elles soient, peuvent être communiquées par télégramme recommandé avec avis d&#x27;arrivée.Article 74La loi réglementant la profession d&#x27;ingénieur du 22 janvier 1951, ses amendements ainsi que les autres textes législatifs contraires à cette loi ou incompatibles avec ses dispositions ont été abrogés.Article 75Dispositions transitoires :A - Dès la promulgation de la présente loi, le Conseil Syndical rédigera un nouveau règlement intérieur dans un délai de quatre mois et le présentera à l&#x27;organe général actuel du syndicat pour approbation ou modification dans un délai de deux mois au maximum. être accompagné de l&#x27;approbation du ministre des Travaux publics.B- Le Conseil Syndical actuel procède à l&#x27;élection des membres du corps délégué conformément aux dispositions de la présente loi et aux dispositions des nouveaux statuts.C-1 - Le Conseil Syndical existant continuera automatiquement jusqu&#x27;à la première séance électorale tenue par l&#x27;Assemblée Générale lors de la première élection tenue conformément à la présente loi. Dans chacun des Syndicats de Beyrouth et de Tripoli, seront élus quatre membres dont le mandat durera. l&#x27;ancien Conseil a expiré, tandis que les autres poursuivront successivement leurs mandats.2- Lors du premier cycle électoral, la composition des membres du Conseil sera complétée par l&#x27;élection de trois nouveaux membres du Syndicat de Beyrouth, à condition qu&#x27;un tirage au sort soit effectué parmi les trois élus, dont le premier servira pour un an, le second pour deux ans et le dernier pendant trois ans.D- Le mandat de l&#x27;actuel président est limité à une durée de trois ans à compter de la date de son élection et se poursuit jusqu&#x27;à la session électorale de mars 1999. Conformément à cette loi, l&#x27;Assemblée Générale élit au cours de la même session un membre pour remplacer le président de terminer son mandat de membre du Conseil syndical.Article 76Cette loi entrera en vigueur dès sa publication au Journal officiel.

الباب الخامس : أحكــام مختلفــةالمادة 71يخضع الصندوق التقاعدي للمهندسين للقانون رقم 11/64 الصادر بتاريخ 19/2/1964.المادة 72يخضع صندوق التقديمات الاجتماعية للنظام الداخلي ولاي نظام خاص آخر يضعه مجلس النقابة وتكون موارده، مؤلفة مما يأتي:1- الرسوم التي تقرها هيئة المندوبين.2- التبرعات.المادة 73تبلغ اوراق مجلس النقابة وقراراته الى اصحاب العلاقة اما شخصياً او بموجب كتاب مضمون مع اشعار بالوصول او بواسطة الكاتب العدل. وفي حال تعذر ذلك بأية وسيلة اخرى يقررها مجلس النقابة او ينص عليها قانون اصول المحاكمات المدنية. مع مراعاة النصوص الخاصة الواردة في هذا القانون. ويمكن تبليغ اوراق دعوات الحضور او المحاكمة اياً كانت بواسطة برقية مضمونة مع اشعار بالوصول.المادة 74الغي قانون تنظيم مهنة الهندسة الصادر في 22 كانون الثاني 1951وتعديلاته وغيرها من النصوص التشريعية التي تخالف هذا القانون او التي لا تأتلف واحكامه.المادة 75أحكام انتقالية:أ- يضع مجلس النقابة عند صدور هذا القانون مشروع نظام داخلي جديد خلال فترة اربعة اشهر يعرضه على الهيئة العامة الحالية للنقابة لاقراره او تعديله خلال فترة شهرين على الاكثر ويجب ان يقترن النظام الداخلي بموافقة وزير الاشغال العامة.ب- يدعو مجلس النقابة الحالي الى انتخاب اعضاء هيئة المندوبين وفقاً لاحكام هذا القانون ولاحكام النظام الداخلي الجديد.ج-1- يستمر مجلس النقابة القائم تلقائياً الى اول دورة انتخابية تعقدها الهيئة العامة في اول انتخاب يجري بموجب هذا القانون وينتخب في كل من نقابة بيروت وطرابلس اربعة اعضاء انتهت ولايتهم في المجلس القديم حيث يتابع الباقون مدة ولايتهم تباعاَ.2- يتم في اول دورة انتخابية اكمال اعضاء المجلس بانتخاب ثلاث اعضاء جدد لنقابة بيروت على ان يتم اجراء القرعة بين الناجحين الثلاث الاول منهم لمدة سنة والثاني لمدة سنتين والاخير لمدة ثلاث سنوات.د- تحدد ولاية النقيب الحالي بمدة ثلاث سنوات من تاريخ انتخابه وتستمر لغاية الدورة الانتخابية في شهر آذار 1999 ووفقاً لهذا القانون تنتخب الهيئة العامة في الدورة ذاتها عضواً يحل محل النقيب لاكمال مدة عضويته في مجلس النقابة.المادة 76يعمل بهذا القانون فور نشره في الجريدة الرسمية.
